Government Enforcement and Internal Investigations partner Philip Moustakis was quoted in a Private Funds CFO article titled, “Court Decisions to Force SEC to Consider Options.”
“Just because rulemaking will be more challenging for the SEC does not mean it will abandon its mission to protect investors and the capital markets,” said Philip. “Instead, to do so, it may have to lean into its enforcement program to achieve desired market behaviors. At which point it will be accused of regulation by enforcement, as they have in the past.”
