Seward & Kissel has represented distressed investors and individual creditors in various capacities in bankruptcy cases and distressed situations. We routinely assist distressed investors in investigating and evaluating potential investments, as well as protecting their interests and executing on potential strategies in restructurings and bankruptcies. Seward & Kissel has advised individual creditors with a number of different relationships to distressed counterparties. We have represented licensees of intellectual property in protecting section 365(n) rights, sale-leaseback counterparties in recharacterization disputes, landlords and tenants in real estate restructurings, critical vendors and suppliers, consignors, and trade creditors, among many others.
